CONDITIONS OF SALE

With “online” sales contract we mean the contract stipulated between the supplier “CANTINE MUCCI” based in
C. da Vallone di Nanni, 65 – 66020 Torino di Sangro (CH) – VAT number 01843010693 , and a customer interested in ‘online purchase of the items offered. The contract will have its conclusion through the use by the customer of the e-commerce platform accessible at www.cantinemucci.com. The customer may be the natural or legal person who purchases goods and / or services for his own purposes. The conditions of sale currently in force are reported below . Any changes to the conditions of sale will be published on the website www.cantinemucci.com and will be considered valid for all purchases made after the publication of the update.

SELLING PRICES

All published prices are inclusive of the VAT rate and are subject to change at any time without notice. For orders from abroad – EU countries For purchases made by subjects who do not have a VAT number, residing both in Italy and in the European Community, VAT will be applied to the sale price. For purchases made by holders of VAT numbers, residing in the territory of the European Community with the exception of Italy, VAT will not be applied as they are considered non-taxable operations pursuant to art. 41 DL 331/93. For orders from abroad – Non-EEC countries for purchases made by any person not resident in the Italian territory and in the European Community, VAT will not be applied as they are considered non-taxable operations pursuant to art. 8 DPR 633/72

PURCHASE METHOD

All ordered goods can be paid for using the payment methods indicated online at the time of purchase. The currently authorized forms of payment are bank transfer upon request, cash on delivery, PayPal. The prices displayed on the site are to be considered valid only for orders placed online . DELIVERY METHODS

“CANTINE MUCCI” will deliver the items purchased to customers through trusted couriers and / or shippers. The shipping address is the one indicated by the customer during registration. In the event that the required shipping address is different from that specified by the customer for billing, “CELLARS MUCCI” reserves the right to ask the customer faxing a photocopy of the front / back of a document of identity and / or other document suitable for proving the identity and residence of the same. In no case will shipments be made to post office boxes, mail boxes and the like. The delivery times of the goods are 2/3 working days following the order. The aforementioned delivery times refer to the products in stock at the time of the order. In case of immediate unavailability of the products (products to order) the delivery times may be longer. However, no responsibility can be attributed to the supplier for delayed or non-delivery due to force majeure or unforeseeable circumstances.

RESPONSIBILITY

“CANTINE MUCCI” assumes no responsibility for inefficiencies attributable to force majeure such as accidents, natural phenomena, and other similar events that prevented, in whole or in part, from executing the contract within the agreed time frame. “CANTINE MUCCI” will not be liable to any party for damages, losses and costs incurred as a result of the failure to execute the contract for the reasons mentioned above, as the consumer is only entitled to a refund of the price paid.

RIGHT OF WITHDRAWAL

The consumer who for any reason is not satisfied with the purchase made, has the right to withdraw from the stipulated contract, without any penalty and without specifying the reason, within 10 working days for the goods from the day of their receipt, for the services from the day of the conclusion of the “on line” contract. The withdrawal must be expressed by sending a registered letter with acknowledgment of receipt within the aforementioned term of 10 days to the following address “CANTINE MUCCI” C. da Vallone di Nanni, 65 – 66020 Torino di Sangro (CH), or by e-mail to info@cantinemucci.com.

Within the aforementioned term of 10 days, all purchased goods must be returned to the sender-supplier intact and in their original packaging and any manuals, without any lack but only after authorization by “CANTINE MUCCI”. The return costs will be charged to the customer except if the goods do not comply with the order, in this case you will be given instructions for shipping carriage forward. “CANTINE MUCCI” will forward the entire amount paid by the consumer within seven days from the date of receipt of the goods shipped by the customer, without prejudice to any repair costs for damage to the goods. It will be the consumer’s responsibility to promptly provide the bank details on which to obtain the transfer.

PROVISION AND PROCESSING OF PERSONAL DATA

Personal data are collected for the purpose of registering the customer and activating the procedures for the execution of the above and the related necessary communications; these data are processed electronically in compliance with the laws in force and may be exhibited only at the request of the judicial authority or other authorities authorized for this purpose by law. The interested party enjoys the rights d.lgs. REG. EU 2016/679 (GDPR) and that is: to ask for confirmation of the existence at “CANTINE MUCCI” of their personal data; to know their origin, logic and purpose of their treatment; to obtain updating, rectification and integration; to request its cancellation, transformation into anonymous form or blocking in case of unlawful processing; to oppose their processing for legitimate reasons or in the case of use of the data for sending advertising material, commercial information, market research, direct sales and interactive commercial communication. JURISDICTION AND COMPETENT COURT

Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated online through the website www.cantinemucci.com is subject to Italian jurisdiction. For any dispute between the parties regarding this contract, the Court of Vasto will be competent.
